Toobal Hits Back at Prosecutor General

The prosecutor general’s move to strip three MPs of parliamentary immunity is politically motivated, Priit Toobal, the secretary general of the Center Party and one of the three MPs in question, said on Wednesday.

Prosecutor General Norman Aas has asked the Chancellor of Justice to petition for the Parliament to strip three Center Party MPs of their parliamentary immunity in connection with alleged instigation to unauthorized surveillance, ETV reported on Wednesday.

Toobal said that until he is convicted in court he will not step down from any position, including his position as the alternate member of the Parliament’s Security Authorities Surveillance Select Committee.

Toobal also said the prosecutor’s move is clearly politically motivated and amounts to political persecution.

Toobal is also suspected of forging accounting documents for the party. Aas told ETV that the forgery case was dropped because the law has changed recently. The amendment decriminalized illicit donations to a political party under 35,000 euros, and since the suspected donation amounted to 11,000 euros, the proceedings were ended.

Countering the prosecutor’s move, Toobal and Lauri Laasi, the second MP threatened with loss of immunity, applied for the implementation of the principle of opportunity, which means that the prosecutionwould agree that there is not enough public procedural interest to pursue the matter.

In their letter to the prosecutor, they cited a similar case where the son-in-law of Prime Minister Andrus Ansip was charged of accessing the e-mail account of his former employee and was not found guilty according to the principle of opportunity. Laasi and Toobal stated that the dismissal of their application would amount to unfair treatment.
